NAME AND LOCATION OF EVENT: LOVE RIDE 34, Sunday, November 9, 2025, H-D of Glendale to Castaic Lake Safety is the primary concern of the Love Ride Foundation ("LRF"), the Harley-Davidson Corporation ("H-D"), Harley-Davidson of Glendale, Inc., ("HOG"), Harley-Davidson Owners Group ("HOG") and Harley-Davidson of Santa Clarita, Inc. "I", "me", "my" and similar terms refer to the above named rider or passenger and apply to a minor child(ren) and/or invited guest(s) as applicable. "You" and "your" refers collectively to the Love Ride Foundation ("LRF"), West Coast Motorcycles, Inc, doing business as Harley-Davidson of Glendale, ("HDG"), Harley-Davidson Corporation ("HDC"), Harley Owners Group ("HOG") and Harley-Davidson of Santa Clarita, Inc. Please observe all federal, state and local laws, and ride safely and defensively. LRF, H·D, HOG request that you wear a helmet, appropriate clothing and eyewear, and that your passenger does also. If you and/or your passenger choose to ride without a helmet, you do so at your own risk. Please always ride with your headlight on and never ride under the influence of alcohol or drugs. In consideration of permitting me (and my minor child(ren) and/or invited guest(s), to participate in LOVE RIDE 34 (the ‘Event), I AGREE THAT BY COMPLETING THIS TRANSACTION, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND ALL OF THE PROVISIONS THAT FOLLOW AND THAT I HAVE FREELY AND VOLUNTARILY AGREED TO ALL OF THE TERMS HEREIN, INCLUDING ALL OF THE FOLLOWING: In consideration of permitting me (and my minor child(ren) and/or invited guest(s)) to participate in the Event (which would not otherwise be given but for this agreement), I release you and your officers, directors, employees, agents and representatives (the "Released Parties") from and waive any and all rights or claims I (and my minor child(ren) and/or invited guest(s)) may suffer including, without limitation, personal injuries or property (real or personal) damages or otherwise resulting from, arising out of, related to or taking place during the Event, regardless of whether all or any portion of any such rights arises out of theories of tort, strict liability, contract, non-disclosure, statutory violation, or otherwise, including, without limitation, the breach of any express or implied warranty offered by any Released Party or the conditions, qualifications, instructions, rules or procedures under which the event is conducted. I understand that this waiver and release extends to and releases and discharges any and all claims, losses and damages I (and my minor child(ren) and/or invited guest(s)) or any of my (and my minor child(ren) and/or invited guest(s)') heirs and assigns suffer, suffered, have or may have against the Released Parties arising out of the Event, regardless of whether any such claims, losses or damages now exist or hereafter arise, are known or unknown, contingent or absolute, liquidated or un-liquidated, foreseen or unforeseen or arise by operation of law or otherwise. I further agree to waive and release the benefits flowing from any federal, state, or local law which would otherwise limit the scope of this release, including, without limitation, California Civil Code Section 1542 which provides as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." I acknowledge that each of you and your representatives have explained and I am (and my minor child(ren) and/or invited guest(s) is) fully familiar with the operation and riding characteristics of the motorcycle(s) I am (and my minor child(ren) and/or invited guest(s) is) riding and that of all motorcycles participating in the Event. I represent to you that I am (and my minor child(ren) and/or invited guest(s)), to the extent he is driving and not just a passenger, is) licensed and fully qualified to ride motorcycles. I (and my minor child(ren) and/or invited guest(s)) seek to participate in the Event voluntarily and of our own free will. I acknowledge that this activity involves dangerous risks that could cause serious injury or death to me (and my minor child(ren) and/or invited guest(s)) and others, whether or not the injury or death is my (or my minor child(ren) and/or invited guest(s)') fault in whole or in part, or that of another person, and I (individually), and on behalf of my minor child(ren) and/or invited guest(s)) voluntarily assume the risk of any such injury or death. I (and my minor child(ren) and/or invited guest(s)) agree to wear a D.O.T. approved motorcycle helmet, proper eye wear and protective clothing at all times while a rider or passenger on the motorcycle. I represent to you that I am (and my minor child(ren) and/or invited guest(s) is) not under the influence of any substance that would impair my (and my minor child(ren) and/or invited guest(s)') ability to operate or ride upon a motorcycle and will not operate or be a passenger on the motorcycle if I (or my minor child(ren) and/or invited guest(s)) later become under the influence of any substance that would impair my (my minor child(ren) and/or invited guest(s)') ability to operate or ride on the motorcycle. I (and my minor child(ren) and/or invited guest(s)) will operate the motorcycle only on public roads or highways, comply with all laws relating to the operation of motorcycles and will not operate it off-road or in any manner related to racing or an exhibition of speed. I represent to you that I (and my minor child(ren) and/or invited guest(s)) have minimum liability insurance required by law and sufficient collision insurance to cover any injury, loss or damage I am (and my minor child(ren) and/or invited guest(s)) may suffer resulting from my (and my minor child(ren) and/or invited guest(s)') use or operation or during the time I (and my minor child(ren) and/or invited guest(s) is) participating in the Event. Although I reserve all my (and my minor child(ren)'s and/or invited guest(s)’s) rights under my (and my minor child(ren) and/or invited guest(s)') own insurance policies, I accept full responsibility for any injury, loss or damage to me, (my minor child(ren) and/or invited guest(s)), any other person or the property sustained or suffered as a result of my (my minor child(ren) and/or invited guest(s)') participation in the Event. I agree to indemnify, defend and hold harmless all Released Parties or any of them from and against any and all claims of any nature, including consequential damages, attorney's fees, costs or other liabilities arising out of the Event or of my (my minor child(ren) and/or invited guest(s)') participation in the Event. If I breach this agreement, or bring any suit or claim barred by its terms, I will pay all attorney's fees, costs, and expense incurred by anyone released herein. I agree that I will pay you for any damage, destruction or loss you incur as result of my negligence, gross negligence, or willful conduct as a participant in the Event including but not limited to charges not immediately paid by my (and my minor child(ren) and/or invited guest(s)') insurance due to deductibles or otherwise. Consent also is hereby given to use of my (and my minor child(ren)’s and/or invited guest(s)') name, picture, portrait, voice, signature, photograph, likeness, writings, or biographical information, and audiotape and/or videotape recordings and sound or silent motion pictures or me (and my minor child(ren) and/or invited guest(s)) in any medium for editorial, educational, promotional and advertising purposes, for the solicitation of contributions, and/or for any other purpose in further of the corporate purposes and objectives of the LRF, without any monetary payment or other consideration paid to you (or your minor child(ren) and/or invited guest(s)). Any suit or proceeding to assert claims arising out of or related to the Event, or interpret or construe the meaning of this agreement shall be brought before and finally determined by an arbitrator based solely upon laws applicable within the State of California but held procedurally pursuant to commercial rules of the American Arbitration Association, so long as you arrange for me to incur no greater fee to the arbitrator than I would have incurred in the generally available court of resolution forum. I recognize that this agreement binds me and my heirs, successors, assigns, agents and personal representatives. I certify that, before completing this transaction, I have read and understood its terms. I have relied exclusively on information from sources other than you or any of the Released Parties in deciding to participate in the Event and sign this release of my own free will. Statements by any person related to you, including statements by any of the Released Parties, if any, are not being relied upon by me, and are superseded by the terms of this agreement, whether they relate to the Event, the places where I ride the motorcycle, the meaning or intent of this agreement, or otherwise. Only a written document signed by you or your authorized representative will be effective to modify or supplement this agreement. I will not rely upon any oral or verbal statement or written statement not signed by you or your authorized representative to modify or supplement this agreement.
